Open Owl Studios ("Open Owl Studios," "we," "us," or "our") makes and publishes tabletop games and ships them to fans around the world. We care about your privacy, and this policy explains what personal information we collect, why we collect it, how we use and share it, and the choices and rights you have.

This policy applies to our website ([openowlstudios.com]), our online store, our crowdfunding campaigns, our newsletters, and our customer support and fulfillment operations. By using our site or buying from us, you agree to the practices described here.

We are based in Kelowna, British Columbia, Canada, and we serve customers globally — including in Canada, the United States, the European Economic Area (EEA), the United Kingdom, and elsewhere. Because of this, different privacy laws may apply to you depending on where you live. Sections below explain rights specific to Canada (PIPEDA / BC PIPA), the EEA and UK (GDPR), and California (CCPA/CPRA).

Information we collect

Depending on how you interact with us, we may collect:

  • Identity and contact information — your name, email address, shipping and billing address, phone number, and the country/region you're in.
  • Order and pledge information — products purchased or pledged for, order history, crowdfunding pledge details, add-ons, and shipping selections.
  • Payment information — payment is processed by our payment and platform providers. We do not store full card numbers on our own servers; we typically receive only limited details such as the transaction result and the last four digits of a card.
  • Account and profile information — if you create an account, your login details and preferences.
  • Communications — messages you send us through email, contact forms, live chat, surveys, or social media, including support requests and replacement-part claims.
  • Technical and usage information — IP address, device and browser type, pages viewed, referring site, and how you navigate our website, collected through cookies and similar technologies (see Cookies and tracking below).
  • Marketing preferences — whether you've subscribed to our newsletter and how you engage with our emails and ads.

We do not knowingly collect sensitive categories of personal information, and we do not ask for them.

How we collect information

We collect information when you:

  • place an order or back a crowdfunding campaign;
  • create an account or subscribe to our newsletter;
  • contact us or request support;
  • respond to a survey, contest, or promotion; or
  • browse our website (automatically, via cookies and similar technologies).

We also receive information from third parties who help us operate, such as our e-commerce platform, crowdfunding platforms, payment processors, and advertising and analytics providers.

How we use your information

We use your information to:

  • process and fulfill your orders and crowdfunding pledges, including shipping through our fulfillment partners;
  • provide customer support, including replacement parts and returns;
  • send you transactional messages (order confirmations, shipping updates, campaign updates);
  • send marketing emails and campaign announcements, where you've subscribed or where otherwise permitted by law;
  • personalize your experience and show you relevant products and content;
  • measure and improve our website, products, and advertising;
  • run, analyze, and optimize advertising campaigns (including on platforms such as Meta);
  • prevent fraud and keep our site and customers safe; and
  • comply with our legal obligations.

Legal bases (EEA/UK). Where the GDPR applies, we rely on: performance of a contract (to fulfill your orders); your consent (e.g., for marketing emails and certain cookies); our legitimate interests (e.g., improving our products, securing our site, and measuring advertising), balanced against your rights; and compliance with legal obligations.

Who we share your information with

We share personal information only as needed to run our business, and we require service providers to protect it and use it only for the services they provide to us. Recipients include:

  • E-commerce and website platform — our online store and hosting provider (e.g., Shopify), which processes orders and stores related data.
  • Payment processors — to process transactions securely.
  • Crowdfunding platforms — such as Kickstarter and Gamefound, when you back a campaign through them (their own privacy policies also apply).
  • Fulfillment and logistics partners (3PLs) — we operate fulfillment hubs in multiple regions, and we share the shipping information needed to pack and deliver your order, including across borders.
  • Email and communication providers — such as our transactional email provider (e.g., Postmark) and our newsletter platform.
  • Advertising and analytics providers — such as Meta and our web analytics provider, to measure performance and deliver relevant ads (see below).
  • Professional advisors and authorities — where required to comply with the law, enforce our terms, or protect our rights, property, or the safety of others.

We do not sell your personal information for money. Some sharing for advertising and analytics may be considered a "sale" or "sharing" under certain U.S. state laws — see the California section below for your opt-out rights.

International data transfers

Because we operate globally and use fulfillment hubs and service providers in multiple countries, your personal information may be transferred to, stored in, and processed in countries other than your own, including Canada, the United States, and the EEA. These countries may have different data protection laws than your home country. Where required, we put appropriate safeguards in place (such as standard contractual clauses) for these transfers.

Cookies and tracking technologies

Cookies are small files placed on your device that help a website function and remember information. We use cookies and similar technologies to:

  • keep your shopping cart and preferences working;
  • understand how our site is used so we can improve it;
  • measure and deliver advertising.

You can set your browser to warn you about cookies or to refuse them. Some parts of our site (like the cart and checkout) may not work properly without certain essential cookies. Where required by law, we'll ask for your consent before placing non-essential cookies, and you can withdraw that consent at any time through our cookie settings.

Advertising and analytics

We use analytics tools to understand site traffic and improve your experience, and we advertise our games on third-party platforms.

In particular, we use advertising tools such as the Meta pixel to measure the performance of our ads and to show relevant ads to people who have visited our site. These tools may set cookies and collect information about your activity on our site.

You can manage ad personalization through:

  • your Meta ad preferences in your Facebook/Instagram account settings;
  • your Google Ad Settings if we use Google services; and
  • industry opt-out tools such as the Network Advertising Initiative and Digital Advertising Alliance opt-out pages, and the Google Analytics Opt-out Browser Add-on.

Do Not Track

Some browsers offer a "Do Not Track" (DNT) signal. There is no consistent industry standard for how to respond to DNT signals, and our site does not currently respond differently to them. You can still manage cookies and ad personalization using the controls described above.

Your privacy rights

Depending on where you live, you may have some or all of the following rights regarding your personal information:

  • Access — request a copy of the information we hold about you.
  • Correction — ask us to fix inaccurate or incomplete information.
  • Deletion — ask us to delete your information.
  • Portability — request your information in a portable format.
  • Withdraw consent — opt out of marketing or withdraw consent where we rely on it.
  • Object or restrict — object to or limit certain processing.

Canada (PIPEDA / BC PIPA). You have the right to access and correct your personal information and to ask about how it's handled. If you have an unresolved concern, you may contact the Office of the Privacy Commissioner of Canada or the Office of the Information and Privacy Commissioner for British Columbia.

EEA / UK (GDPR). You have the rights listed above, and you may lodge a complaint with your local data protection authority (in the UK, the Information Commissioner's Office).

California (CCPA/CPRA). You have the right to know what personal information we collect and how it's used and shared, to request deletion or correction, and to opt out of the "sale" or "sharing" of your personal information for cross-context behavioral advertising. Data retention

We keep personal information for as long as needed to fulfill the purposes described in this policy — for example, to complete your orders, support warranty and replacement requests, comply with tax and accounting obligations, and resolve disputes. When we no longer need it, we delete or anonymize it.

How we protect your information

We use a combination of technical and organizational safeguards to protect your information, including encryption in transit (SSL/TLS), restricted access on a need-to-know basis, and secured networks. Payment transactions are handled by our payment providers and are not stored on our own servers. No method of transmission or storage is completely secure, but we work to protect your information and to limit access to it.

In the event of a data breach affecting your personal information, we will notify you and the relevant authorities where required, without undue delay and in accordance with applicable law.

Children's privacy

Our store and website are intended for adults. We do not knowingly collect personal information from children under the age of 13 (or the equivalent minimum age in your country) without verifiable parental consent. If you believe a child has provided us with personal information, please contact us and we'll delete it.

Email and marketing communications

If you've subscribed, we may send you newsletters, campaign announcements, and product news. You can unsubscribe at any time using the link at the bottom of any marketing email, or by contacting us at [hello@openowlstudios.com], and we'll promptly remove you from our marketing lists. We'll still send you essential transactional messages related to your orders and pledges. We comply with applicable anti-spam laws, including Canada's CASL and the U.S. CAN-SPAM Act.

Changes to this policy

We may update this policy from time to time. When we do, we'll change the "Last updated" date above and post the revised version on this page. Significant changes may be communicated more directly where appropriate.
